PRICES SUBJECT TO CHANGE
In the event 10% or more of your poultry arrives dead on arrival, the Supervisor, Claims Appeals, states that claims must be filed on PS Form 1000 by the addressee at their post office as soon as the poultry are received dead on arrival. By doing so, confirmation of postal responsibility will be on the claim form when our office receives it.

WARRANTY

Seller will deliver to Buyer the hatched baby poultry described in this agreement in good condition so far as can reasonably be determined at the time of delivery by Seller who has exercised flock control, egg selection, production and handling methods recommended and approved by the industry.

Seller and Buyer recognize that there are certain factors which may materially effect the health or value of poultry, the extent or presence of which are unascertainable at the time of delivery.

THEREFORE, IT IS UNDERSTOOD, AGREED AND CONSIDERED REASONABLE THAT THERE ARE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE POULTRY OTHER THAN THOSE SPECIFICALLY STATED IN THIS AGREEMENT AND SELLER SPECIFICALLY DISCLAIMS ANY WARRANTY OF MERCHANTABILITY OF THE POULTRY AND ANY WARRANTY OF FITNESS OF THE POULTRY FOR ANY PURPOSE OR OF THE SUITABILITY OF THEM FOR ANY USE.

It is expressly understood that any adjustments will not exceed the original purchase price and Buyer shall not be entitled to any incidental or consequential damages as defined in the Uniform Commercial Code as a result thereof. All claims for adjustments must be made in writing not later than fifteen (15) days after delivery of the poultry.
